2026 Florida real estate FAQ
What closing costs should a Florida buyer budget for?
With a mortgage, Florida charges documentary stamp tax on the note ($0.35 per $100 of the loan) and a 0.2% intangible tax on the new mortgage. Add lender fees, the lender's title policy, settlement and recording fees, prepaid interest and escrow deposits. Who pays the owner's title policy depends on the county custom and the contract. The closing cost calculator shows every line.
Who pays the real estate commission?
Commissions are negotiable. Since 2024, buyers sign a written agreement with their agent before touring homes that states how their agent is paid. A seller can still offer to cover the buyer's agent, and that is often part of the negotiation.
How does the November 2026 property tax vote affect buyers?
Amendment 3 would raise the homestead exemption for non-school taxes to $150,000 in 2027 and $250,000 in 2028, and cut the yearly cap on non-homestead assessment increases from 10% to 5%. People who are not Florida residents on December 31, 2026 would get the larger exemption only from their fifth year. It needs 60% of the vote.
How long do I have to cancel a resale condo purchase?
Since July 1, 2025, a buyer of a resale condo can cancel within 7 days after receiving the association documents, not counting weekends and legal holidays, and the right ends at closing. Use that time to read the budget, the reserve study and any planned special assessments.
Can foreigners and Canadians buy property in Florida?
Yes. There is no federal ban on foreign buyers in Florida. A recent Florida law restricts buyers connected to certain countries, so check whether it applies to you before you sign. When a foreign owner later sells, the buyer must usually withhold 15% of the price under FIRPTA unless an exception or an IRS withholding certificate applies.
What is your property actually worth?
